If your property was built before 1978, it may contain lead-based paint. The federal government requires that landlords or sellers of property must disclose the presence of lead-based paint to their tenants or buyers, with the exception of housing for the elderly or persons with disabilities more than 6 years of age or any zero bedroom dwelling. Failure to comply with this disclosure requirement can have serious consequences–both for tenants, especially children who may be exposed to lead paint, and for landlords, who can be held legally liable with penalties of up to $11,000 per violation.
